1. Agreement to Terms

Welcome to Code-Build. These Terms of Service govern your use of our cloud-based coding environment service at code-build.com (the "Service").

By accessing or using Code-Build, you agree to be bound by these Terms. If you do not agree, you may not use the Service.

2. Description of Service

Code-Build provides:

  • Cloud-Based Coding Environment: Personal VS Code workspace accessible from any device
  • Development Tools: Pre-configured development tools, libraries, and extensions
  • Storage: Persistent storage for your code, files, and projects
  • Subscription Plans: Free Trial, Plus (£4.99/month), and Pro (£50/year)

3. Account Registration

3.1 Eligibility

You must be at least 13 years old to use Code-Build. Users under 18 should have parental/guardian consent.

3.2 Account Information

You agree to:

  • Provide accurate and complete information during registration
  • Maintain the security of your password
  • Notify us immediately of any unauthorized account access
  • Accept responsibility for all activities under your account

4. Subscription Plans and Payment

4.1 Available Plans

Free Trial:

  • Duration: 30 days
  • Access: Full features
  • No credit card required
  • One trial per user

Plus Plan:

  • Price: £4.99 per month
  • Billing: Monthly recurring
  • Access: Unlimited, no time limits

Pro Plan:

  • Price: £50 per year
  • Billing: Annual recurring
  • Access: Premium features, expanded storage & performance

4.2 Payment Processing

  • All payments are processed securely by Stripe
  • We do not store your credit card information
  • Prices are in GBP (£) and include applicable taxes
  • Payment is due at the start of each billing period

4.3 Automatic Renewal

Paid subscriptions automatically renew at the end of each billing cycle unless cancelled before the renewal date. You will be charged on your subscription anniversary.

5. Free Trial Terms

New users receive a 30-day free trial with full access. No payment information required. One trial per user (based on email address).

After Trial Expiration:

  • Your workspace becomes read-only
  • You can upgrade to a paid plan to restore full access
  • Your data is retained for 30 days after expiration
  • After 30 days, your workspace may be permanently deleted

6. Cancellation and Refunds

6.1 Cancellation

You may cancel your subscription at any time from your account dashboard. You retain access until the end of your current billing period, and no further charges will be made.

6.2 Refund Policy

Monthly Plans (Plus):

  • No refunds for partial months
  • Cancel anytime to avoid future charges
  • Access continues until the end of the paid period

Annual Plans (Pro):

  • Refunds available within 14 days of initial purchase (UK Consumer Rights)
  • No refunds after 14 days or for renewals
  • Pro-rata refunds not available

For refund requests: Email support@code-build.com with subject "Refund Request"

7. Acceptable Use Policy

7.1 Permitted Uses

You may use Code-Build for:

  • Personal coding projects and learning
  • Educational purposes
  • Commercial software development
  • Portfolio creation

7.2 Prohibited Activities

You may NOT use Code-Build to:

  • Violate any laws or regulations
  • Infringe intellectual property rights
  • Distribute malware, viruses, or harmful code
  • Harass, abuse, or harm others
  • Attempt to bypass security measures
  • Cryptocurrency mining or similar resource-intensive tasks
  • Hosting public websites or servers (personal development only)
  • Upload illegal, harmful, or offensive content

7.3 Enforcement

Violation of these terms may result in warning, temporary suspension, permanent termination without refund, or reporting to law enforcement for illegal activities.

8. Intellectual Property

8.1 Your Content

You retain all rights to the code, files, and content you create in your workspace. We grant ourselves a limited license to store and display your content to provide the Service.

We will never:

  • Claim ownership of your code
  • Share your private content with third parties
  • Use your content for training AI models without consent

8.2 Our Platform

Code-Build, including its software, interface, design, logos, trademarks, and documentation, are owned by us and protected by UK and international intellectual property laws.

9. Service Availability

We strive for 99% uptime, but we do not guarantee uninterrupted access. The Service may be unavailable due to scheduled maintenance, emergency maintenance, technical issues, or force majeure events.

You are responsible for maintaining your own backups. We are not liable for data loss. Use version control (Git) and external backups for important projects.

10. Termination

You may terminate your account at any time. We may suspend or terminate your account if you violate these Terms, your account is inactive for 12+ months, we discontinue the Service (with 30 days' notice), or as required by law.

Upon termination:

  • Your access to the Service ends immediately
  • Your workspace data will be deleted within 30 days
  • Paid subscriptions are non-refundable (except as stated in Section 6)
  • You may request a data export before deletion

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. We disclaim all warranties, including merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation.

Use at your own risk.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY UK LAW: We are not liable for indirect, incidental, or consequential damages, loss of profits, data, or business opportunities, or damages exceeding the amount you paid in the past 12 months.

Exceptions: Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under UK law.

13. Governing Law and Disputes

These Terms are governed by the laws of England and Wales. Before taking legal action, please contact us at support@code-build.com to resolve disputes informally. Any legal proceedings must be brought in the courts of England and Wales.

Nothing in these Terms affects your statutory rights as a consumer under UK law.

14. Changes to Terms

We may update these Terms at any time. Changes will be posted on this page with an updated "Last updated" date. Material changes will be notified via email and prominent notice on the website.

Continued use after changes constitutes acceptance. If you disagree with changes, you must stop using the Service.
